The SVHOA Board promised you an update in May on the covenant survey and whether we gathered enough interest to move forward with a vote. The vote is regarding a change in paint colors allowed for shutters and doors AND additional fencing materials allowed in Sections 1-4. Yes, we received sufficient interest to move forward. Thank you for your participation!!
Next we needed a legal opinion from SHVOA, Inc.'s attorney ASAP, which was earlier today. In brief, his legal opinion is that we cannot use a ballot as a legal instrument to change the covenants. Instead, we must get original signatures on an amended Deed of Dedication (DOD) from each Lot owner in an organized manner.
Here's the plan:
- As it stands, signatures will be taken at the Rec. Center and recorded by the SVHOA Secretary in the month of June 2021 ( and if needed in July 2021. The sooner we reach 90% the sooner we can move forward with a final decision on changes but we will end this opportunity to sign an amended DOD in July 2021). Please note:
- The opportunity for special arrangements to sign at another location or outside of the posted hours will be in the notice noted below for special circumstances. The Board wants to offer everyone the opportunity to participate in this important decision by access to the amended DOD for signature.
- You must add your signature to your Section's new amended DOD to approve changing paint colors and fencing materials - this is your yes vote. Remember, 90% of all lot owners in your Section must sign for the amendment to pass.
- You do not add your signature, if you do not want to change paint colors and fencing materials. So, missing signatures count as no votes.
- A notice will go to each Lot owner early in June describing:
- What their DOD amendment is about,
- What happens when you sign or don't sign the DOD, and
- When and where you can sign the DOD to approve the amendment
- Regular hours for taking signatures will be posted in this notice
